1. Acceptance of Terms

Welcome to Sea Turtle Style. These Terms of Service (“Terms”) govern your access to and use of seaturtlestyle.com (the “Site”) and any purchases made through our Site. By accessing the Site or placing an order, you agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference.

If you do not agree to these Terms, please do not use our Site or place orders. We reserve the right to update these Terms at any time. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

These Terms constitute a legally binding agreement between you and Sea Turtle Style, a business based in Oak Island, North Carolina, USA.

2. Product Descriptions and Accuracy

We strive to ensure that product descriptions, images, pricing, and availability information on our Site are accurate and up to date. However, we do not warrant that product descriptions or other content on the Site is complete, reliable, current, or error-free.

• Colors: Product colors may appear slightly different on your screen depending on your device’s display settings. We are not responsible for color variations attributable to screen calibration differences.
• Sizing: We provide sizing guides for apparel products. Fit may vary depending on the manufacturing partner fulfilling your specific order. We encourage you to consult our sizing charts before purchasing.
• Availability: All products are subject to availability. We reserve the right to discontinue any product at any time without notice.
• Pricing: Prices are displayed in US dollars and are subject to change without notice. The price charged will be the price displayed at the time you complete your order.

3. Order Acceptance and Cancellation

3.1 Order Acceptance

Your receipt of an order confirmation does not constitute our acceptance of your order. We reserve the right to accept or decline your order for any reason, including but not limited to product unavailability, errors in product or pricing information, or concerns regarding fraud.

An order is accepted and a contract is formed when we send you a shipment confirmation email indicating that your order has been dispatched to our fulfillment partner.

3.2 Order Cancellations

Because our products are custom printed or fulfilled on demand, orders enter production shortly after they are placed. As a result:

• Cancellations requested within 1 hour of order placement may be accommodated at our discretion.
• Once an order has entered production or been submitted to a fulfillment partner, it generally cannot be cancelled.
• If you need to cancel an order, please contact us immediately at orders@seaturtlestyle.com with your order number.

3.3 Returns and Exchanges

Our return and exchange policy is detailed on our Returns page at seaturtlestyle.com/returns. As our products are print-on-demand and custom-made, we generally do not accept returns or exchanges for buyer’s remorse. We do, however, replace defective items or orders that arrive damaged. Please inspect your order upon delivery and contact us within 7 days of receipt if there is an issue.

4. Payment Terms

We accept all major credit cards and other payment methods available through WooCommerce Payments (powered by Stripe). By providing payment information, you represent that you are authorized to use the payment method and authorize us to charge the full amount of your order, including applicable taxes and shipping fees.

• All prices are in US dollars.
• Payment is due in full at the time of purchase.
• Sales tax will be collected where required by law.
• We do not store your full payment card details. All payment data is handled by Stripe, our PCI-DSS compliant payment processor.

We reserve the right to refuse or cancel any order where we suspect fraud or unauthorized use of a payment method.

5. Shipping

We currently ship within the United States only. Estimated shipping times are provided at checkout and are estimates only — actual delivery times may vary due to fulfillment partner production schedules, carrier delays, or factors outside our control. We are not responsible for delays caused by shipping carriers, customs, natural disasters, or other circumstances beyond our reasonable control.

Risk of loss and title for items purchased from our Site pass to you upon delivery to the shipping carrier. We are not responsible for lost or stolen packages after carrier confirmation of delivery.

6. Intellectual Property

All content on the Site — including but not limited to original artwork, graphic designs, logos, product designs, photographs, text, and the “Sea Turtle Style” brand name — is the exclusive intellectual property of Sea Turtle Style and is protected by United States and international copyright, trademark, and other intellectual property laws.

• You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any of our content without our prior written consent.
• Our original sea turtle-themed designs are proprietary and may not be copied, imitated, or used in any commercial manner without express written permission.
• The Sea Turtle Style name, logo, and related marks are trademarks of Sea Turtle Style. Nothing on the Site grants you any license or right to use our trademarks.

If you believe any content on our Site infringes your copyright, please notify us at shell@seaturtlestyle.com with sufficient detail to allow us to investigate your claim.

7. Prohibited Conduct

You agree not to:

• Use the Site for any unlawful purpose or in violation of these Terms.
• Attempt to gain unauthorized access to any portion of the Site or any related systems.
• Use automated means (bots, scrapers, spiders) to access, collect data from, or interact with the Site.
• Submit false or misleading information, including fraudulent orders or payment details.
• Upload or transmit viruses or any other malicious code.
• Engage in any conduct that could damage, disable, or impair the Site or interfere with other users’ use of the Site.

8. Disclaimer of Warranties

THE SITE AND ALL CONTENT, PRODUCTS, AND SERVICES AVAILABLE THROUGH THE SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that the results obtained from the use of the Site will be accurate or reliable.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SEA TURTLE STYLE AND ITS OWNERS, EMPLOYEES, AGENTS, SUPPLIERS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

• Your use of or inability to use the Site or any products purchased through the Site;
• Unauthorized access to or alteration of your transmissions or data;
• Any conduct or content of any third party on the Site;
• Any errors, inaccuracies, or omissions in any content or information on the Site.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED US DOLLARS ($100.00).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages, so some of the above limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless Sea Turtle Style and its officers, directors, employees, agents, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to: (a) your violation of these Terms; (b) your use of the Site; (c) your violation of any rights of a third party; or (d) your violation of any applicable law or regulation.

11. Governing Law and Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of law provisions. You agree that any legal action or proceeding arising out of or relating to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Brunswick County or New Hanover County, North Carolina, and you hereby consent to the personal jurisdiction of such courts.

11.2 Informal Resolution

Before initiating any formal legal proceeding, you agree to attempt to resolve any dispute informally by contacting us at legal@seaturtlestyle.com. We will attempt to resolve the dispute informally within 30 days.

11.3 Class Action Waiver

TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDING WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION.
